E AVANTGARDE – TERMS AND CONDITIONS
## B2C – CONSUMER
### 1. PURCHASING FROM E AVANTGARDE
No binding purchase agreement has been entered into with E Avantgarde until you have received an order confirmation from us.
### 2. PRICES
All prices include 25% VAT and are stated in Danish kroner unless otherwise indicated.
The prices apply only within the borders of Denmark, excluding the Faroe Islands and Greenland.
We reserve the right to changes due to:
* Currency fluctuations* Force majeure* Failure of delivery* Changes in duties and taxes* Sold-out items and printing errors
### 3. SALES – GENERAL
The price stated at the time of ordering is the applicable purchase price.
E Avantgarde reserves the right to charge an order fee of DKK 50.00 incl. VAT if the order has not been placed via the E Avantgarde website.
### 4. PACKAGING
The item must be returned in its original and unopened packaging, as the item must subsequently be capable of being sold as new.
### 5. DELIVERY
We reserve the right to sold-out items and delayed delivery times from E Avantgarde's suppliers.
### 6. CANCELLATIONS
If you wish to cancel or annul an order that has already been placed, this should normally be done by sending an email with the subject **"Cancellation"** to ordre@e-avantgarde.dk. The time of ordering and the order number should be stated.
If you have received an order confirmation by email, you may return this to the sender with the text **"Cancellation!"** inserted in the subject line. Cancellation must be made before 14:00 (2:00 PM) on the same day the order was placed.
### 7. PAYMENT
The available payment methods are:
* **Dankort*** **Visa*** **Mastercard*** **MobilePay**
Payment is only charged when your goods have been dispatched. If there is a period between placing the order and payment, the amount may be reserved on your account until the final charge is made.
### 8. RIGHT TO COMPLAIN
There is a 2-year right to complain about products purchased from E Avantgarde. The difference between the right to complain and a warranty can be found under Buyer Rules. If additional rights to complain or a warranty apply, this will be stated separately on the invoice.
Should the item unexpectedly break during the complaint period, it will be repaired free of charge by us.
Damage to the product caused by modifications or misuse by the user is not covered by the right to complain.
### 9. EXERCISE OF THE RIGHT TO COMPLAIN
Complaints regarding defects and deficiencies must be submitted within a reasonable period after receipt of the goods.
The customer is strongly encouraged to provide a statement describing the defect or deficiency in connection with the complaint, as failure to do so may prolong the remedial process due to troubleshooting.
Goods that are not covered by the right to complain and/or are received without proper packaging will be repackaged, and an amount corresponding to E Avantgarde's costs for necessary and proper packaging will be charged.
Goods returned cash on delivery or sent without postage will be refused by E Avantgarde.
### 10. RETURNED GOODS THAT DO NOT CONTAIN A DEFECT
If defective or incorrect goods are returned to E Avantgarde and the defect described and stated by the customer cannot be identified, the goods will be returned to the customer including a testing fee.
The testing fee is DKK 400 per hour incl. VAT. The testing fee is calculated based on the time spent testing and troubleshooting.
### 11. PROPER RETURN OF GOODS
All products returned to E Avantgarde must be properly packaged.
E Avantgarde recommends that the goods are returned via GLS or UPS and sent as parcel post.

## BUYER RULES
### 1. RIGHT TO COMPLAIN
The right to complain gives the customer the right to complain about goods with defects or deficiencies that were present when the goods were sold. The customer has two years to discover and complain about such defects. During the first 6 months, the burden of proof lies with the seller, while during the following 1½ years it lies with the customer. The right to complain is a statutory right.
### 2. WARRANTY
A warranty is a voluntary agreement between the buyer and seller. If a two-year warranty is agreed, the customer may complain about all types of defects and deficiencies during the warranty period. In this case, the seller must prove that the defect is due to misuse by the customer. A warranty is not a statutory right.
### 3. RIGHT TO REPLACEMENT
As a general rule, the consumer may request that an item be replaced instead of accepting a repair.
### 4. REASONABLE PERIOD
Under the new Danish Sale of Goods Act, the consumer always has two months to react after a defect or deficiency in an item has been discovered.
### 5. PRESUMPTION RULE
The presumption rule means that, within the first six months after purchase, it is presumed that the defect was present at the time of purchase.
## RIGHT OF WITHDRAWAL
### 1. 14-DAY RIGHT OF WITHDRAWAL
When purchasing by telephone or online, the consumer has a 14-day right of withdrawal. The right of withdrawal applies from the time the goods are handed over to the consumer. If you withdraw from the purchase within 14 days, we will refund the price of the goods.
To exercise the right of withdrawal, the goods must be handed over to GLS, UPS or another carrier no later than 14 days after receipt. The goods must be returned in substantially the same condition as when handed over.
### Testing the goods and packaging
You are only liable for any reduction in the value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functionality of the goods. The goods should be properly packaged when returned. You bear the risk for the parcel until we receive it. Return postage is paid by the consumer.
### 2. HOW TO RETURN THE GOODS
There are 2 ways to return the goods:
* Refuse to accept the goods and ask the carrier to return them to E Avantgarde.* Accept the goods and return them within 14 days together with a copy of the invoice.

### PRACTICE
The following terms and conditions apply to business purchases, B2B.
When you place an order with us, you accept the terms and conditions that apply at the time you place your order. Please make sure that you have read and understood the applicable terms and conditions before placing your order. We reserve the right to change the terms from time to time without further notice.
These terms and conditions of sale and delivery apply to purchases of goods on E-avantgarde.dk.
### ORDER RECEIPT

### DELIVERY
**Denmark**
At E Avantgarde, we deliver your order with GLS or UPS. On weekdays, we aim for a delivery time of 1–2 business days. During holidays and public holidays, delivery may take a few additional days. If you place your order before 12:00 noon on weekdays, we will endeavour to dispatch it the same day.
**International shipments**
We ship to the following countries:
Norway, Sweden, United Kingdom, Germany, the Netherlands, France, Belgium, Luxembourg, Poland, Finland, the Faroe Islands and Ireland.
All international shipments are delivered by UPS and sent as insured parcels.
Regular service within Europe is approximately 2–5 business days.
Regular service outside Europe is approximately 3–5 business days.
We do our best to dispatch your parcel as quickly as possible, but please note that delivery may be delayed during holidays and public holidays.
All orders are subject to a shipping fee to cover shipping and packaging costs. Goods are delivered by carrier or GLS in Denmark and UPS in other countries.
### PAYMENT TERMS
E Avantgarde accepts payment by Dankort/VISA-Dankort, VISA and MasterCard. Payment will only be charged to the buyer's account when the goods are dispatched.
Customers who wish to be set up for invoice purchases may, subject to credit approval, be approved for payment by invoice.
All amounts are stated in DKK or Euro and are shown excluding VAT. We reserve the right to errors in prices and to sold-out/discontinued goods.
### RETURNS
There is normally no right of withdrawal for business customers. In certain special cases, returns/exchanges may be accepted by prior agreement and only if the goods are in intact condition and in their original packaging. Costs associated with returning the goods, as well as any shipping fee already charged, will not be refunded.

### WARRANTY AND COMPLAINTS
Unless otherwise agreed, business customers are only granted a 12-month right to complain, and complaints must be made immediately after a defect or deficiency is discovered. Business customers have an obligation to carry out such an inspection of purchased goods as required by proper business practice. Replacement or repair does not result in a new 1-year complaint period for the goods.

Any dispute between E ApS and the customer (B2B) is subject to Danish law.
### PRODUCT LIABILITY
To the extent that E ApS is liable to the buyer, this liability is limited to direct loss (maximum the price of the goods) and therefore does not cover consequential losses. Any compensation can therefore not exceed the price of the goods.
We reserve the right to errors in prices and proofreading, technical errors, sold-out goods and force majeure, including labour disputes and deficiencies in or delays to deliveries from subcontractors.# CONFIDENTIALITY POLICY, PRIVACY AND COOKIES
### Confidentiality policy
E ApS processes your personal data for the purpose of being able to deliver the goods to you and to process enquiries regarding your purchase. The processing is carried out in accordance with our personal data policy.
